BeOrchid LLC ("we", "our", or "us") operates the Thrivo mobile application. This Privacy Policy explains how we collect, use, share, and protect your personal information. By using the App, you agree to this policy.

Thrivo uses the following third-party services. Each has its own Privacy Policy:
Health data you enter (weight, calories, macros, mood) is used solely to power Thrivo's tracking and coaching features. This data is stored securely and is not shared with third parties for advertising purposes.
We retain your data for as long as your account is active. If you delete your account, we will delete or anonymize your personal data within 30 days, unless retention is required by law.

If you are a California resident, you have the right to know what personal information we collect, to request deletion, and to opt out of the sale of personal information. We do not sell personal information. To submit a CCPA request, email subscriptions@beorchid.com.
If you are in the European Economic Area, our legal basis for processing your data is your consent (for health data) and the performance of our contract with you (for account and subscription data). You may withdraw consent at any time by deleting your account.
Thrivo is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, contact us at subscriptions@beorchid.com and we will delete it promptly.
We implement industry-standard technical and organizational measures to protect your data, including encrypted storage and secure API communication. However, no method of transmission over the internet is 100% secure.
We may update this Privacy Policy from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the App after changes constitutes acceptance.

These Terms of Service ("Terms") govern your use of the Thrivo mobile application provided by BeOrchid LLC. By downloading or using the App, you agree to these Terms.
You must be at least 13 years old to use Thrivo. Users under 18 must have parental or guardian consent.
After cancellation, Premium access continues until the end of the current billing period. We do not offer refunds for partial billing periods, except where required by law. BeOrchid LLC does not store your payment card information.
New users are eligible for one 7-day free trial. You will be charged $14.99 at the end of the trial unless you cancel before it expires through the App Store or Google Play settings.
All content, features, and functionality of the App are owned by BeOrchid LLC and protected by copyright, trademark, and other intellectual property laws. You may not reproduce or distribute any part of the App without our express written permission.
The App integrates RevenueCat, Stripe, Sentry, Mixpanel, Open Food Facts, Resend, and Cloudflare. Your use of these services is subject to their respective terms. We are not responsible for third-party service providers.
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App or by contacting subscriptions@beorchid.com.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, BEORCHID LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEORCHID LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved in the state or federal courts located in Delaware.
We may update these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance.
